Can't really tell much from the picture, except that it looks to be more than just some scuffed paint. Why buy a bike that is damaged to an unknown degree in a structurally critical location (drive-side chain-stay). When does that bike fail? When applying maximum force to the pedals...that's not a good time to have the bottom half of the bike come apart.
