Ceramicspeed OPWS installation help

I bought the Ceramic OPWS for etap on my Shiv TT bike. Installation was easy enough and with the chain on, the derailleur can be adjusted properly (B screw) and shifting works properly.
The problem is when there is no chain or there is no tension on the chain and the pulley cage is in a no tension or relaxed position, so rotates up, the upper pulley contacts the cogs. This not a B screw issue and the derailleur is installed properly. It just appears that the pulley is just too big.
Anybody had a similar issue on installation?

I talked with Ceramicspeed today and it is the way the OPWS is designed that the upper pulley will come in contact with the (probably) lower 3 cogs when there is no chain tension to pull the pulley cage down.
