Bens pic on the ST homepage of him winning Alcatraz shows him wearing one of these. Are they now legal for use in North America? Or is that race not subject to the same rules as WTC etc?

It doesn’t have the necessary certification stickers, only approved for Europe I think.
But as one of the other replies noted, there is a loophole for pros I guess..
