2 people having a vocal disagreement. #1 tells #2 "get away from me, or I'll kick you in the nuts". #2 closes space instead of backing off. #1 follows through with threat. Brawl ensues.

In a corporate environment (Canada) wouldn't both of these dicks be unemployed?

I have been told physical violence is justified firing and no severance, so yeah they should both be unemployed.

I worked at UPS for a number of years and was a member of the Teamsters. I know people like to characterize unions as protecting members at all cost but two things were not tolerated, violence and stealing. One guy I worked with who had a real temper problem was fired for threatening violence against a supervisor (while also hurling a bunch of racial epithets). Cops were called and escorted him from the building and everything.

Yeah isn't that the definition of self defense? Someone threatens you and causes a rational person to believe they intend bodily harm? That should be deserving of the threatened person defending themselves even if it is a nut kick.
