No matter what HITLERBUSH will nominate someone this side Stalin. Who ever survives the selection process will then be bashed to pieces for being a stooge. The same people will begin to say the same shit no matter what HITLERBUSH’s nominee judge. The courst will continue to make shitty rulings and as long as it isn’t a key button issue no one will care until the court rules on someones little hot button.

I would love nothing more to see Ashcroft nominated. But it will never happen. I remember before he was AG there was some serious talk of nominating him to the SC if he lost the senate race in 2000. I was talking with my sister about this last week along with another friend of ours in the administration and we all agreed it would never happen. But it is cool to dream.

well, i think the point you are missing is that given the current political climate and the specific justice who retired, there will most likely be a new round of far reaching “hot button” cases trying to make their way to the scotus with the likelihood that some will be granted cert. in addition, i am quite certain there will be new legislation passed in light of the new make up of the court. you can keep on with your it doesn’t matter, both sides are the same stuff, but this nomination is an important thing and will have more impact than any election…

Also, no one is actually interested in the things he’s not interested in so no one knows anything that he doesn’t.

No my point is that no matter who is chosen the same shit is going to be said. Bush is a politician and by the nature of his make up he worries about what everyone thinks of him. My theory is the facts will show whoever he nominates will be a middle of the road political hack who will not make any real judgments on the constitution and instead want to come to a conscience.

Cute. Hilarious. I am not being sarcastic, that made me chuckle. I should mention that I’ve met Ashcroft several times and I know he is a very nice and level headed, fair, honest guy. I also know several Bushes very well - none of them in DC, but some of the extended tribe - and they are all very nice people. So I might be somewhat biased reading about how evil they are or what their true hidden motives are.

Because of all the shit said by the left. I know I am not popular for saying this and you are all tired of me but who ever Bush throws up there will be attacked by the usual suspects with the usual shit.

If the balance is switched to the right by one judge then you going to have to prove that.

o’connor was unequivocally the swing vote on teh court. it’s not even debatable. everyone on both sides would agree to that. the 5-4 balance on a lot of issues is very much up in the air with her resignation.

and i know there will be a lot of fighting over this, but the reason there will be fighting is the right wants a change in philosophy, generally speaking, while the left is more content with the makeup of the court prior to o’connor’s resignation.

Chances are I’m not going to like any of Bush’s nominees as they will be chosen largely on what they think of Roe. that’s not paranoia or conspiracy theory, that’s the party platform.

Bush is likely going to get two candidates, my guess is a woman and a hispanic man (to replace Rehnquist with Scalia taking Chief Justice).

The woman will undoubtedly be more conservative than O’Connor and really Rehnquist is a wash.

Will it be enough to overturn Roe/Griswold/Casey?
Probably not.

You’ll get Souter, Ginsburg, Breyer & Stevens definitely coming pro-choice.
You’ll get Scalia, Thomas & Rehnquist definitely coming pro-life.
Kennedy and O’Connor were your swing votes.

O’Connor will be replaced with a pro-life (and Rehnquist’s replacement will be a wash, as I said), so we’re left with Kennedy as the swing and a tie on each side.

The thing is, there’s no real telling where Kennedy will go on Roe or Griswold. He went pro-choice on Casey but that’s just one case, it’s not an accurate predictor.

So instead of two swing votes we’re down to one and even closer to loss of reproductive control rights.

If you don’t care about abortion rights it’s not a big deal. But some people do care about abortion rights, so this is a big deal to them, and justifiably so when you look at the make-up of the existing court.
