I just read in a recent issue of The Ride magazine that damage to your bicycle caused by the state’s failure to maintain a public way will be reimbursed up to $5000. You need to submit a claim within 30 days in Massachussetts describing the date, time and place. Other states policies may vary. Any lawyers out there confirm this? How small a claim can you submit? I cant believe I have been buying tubes all these years after smacking pot holes. From now on, I will just ring up Ahhhnold, the governator, now and ask for my 5 bucks.
How about for the body?
Dave
I believe the $5000 cap was for the total damage. Bike and rider
Make sure you have a police report from the accident scene. They required this in Virginia.
I know that this works in Ohio for cars. I had a boss that drove a GTI with the BBS rims. He busted up two of them on a pot hole. Took pictures of te offending hole and submitted them to the City (Cleveland) and State. He was reimbursed in full for the two rims and tires at $ 950 per set.
Pretty sweet deal if you ask me.
There was a professor from UT Austin that died when his bike hit one of those temporary mounds of dirt and metal they will put over areas that they are working on. I will try and find the outcome, but I think his family did sue the city over it.
SWEET SIG PAT!!! Has she uh… called back?
