Edit: I misread the article and thought the fetus was at 20 weeks.This would be an illegal abortion in KS.

Kansas prohibits abortion after 22 weeks. I don’t think any States allow abortion at the 29 week mark. That’s in the third trimester, and past the typical time period when a fetus reaches viability.

I am not familiar with Nebraska laws pre-Dodd, but I think this could have landed them in jail even back then. 29 weeks was illegal in many states when Roe was in place.

The takeaway data point (it helps to read what the adults were discussing and not the red herrings of the mentally unstable) was the number of states where aborting after viability up through full term electively is perfectly legal is not insignificant.

Just for the record I’ll assume you’d support a compromise of restrictions on elective abortions at 20 weeks and under in exchange for nationwide legality based on your comment which demonstrates there’s really no need to have an elective abortion after 20 weeks.

Windy, I am not American/do not work in the USA and my job as a specialist/professor in obstetric anesthesiology puts me in a difficult situation on many levels. I have to keep any pro life/pro choice views to myself in general, we are required to serve the patients that we serve under the relevant legislation in the varying states in my country. So I apologise for appearing to sit on a fence. What I have found with the laws etc in this area is that it is a little like the covid vax pro and anti movements, peoples opinions/choices are very firmly entrenched and there is no point in trying to have them see the other sides of the argument/persuade them to change their minds.

Have not fact check beyond michigan so there are 7 states (where possibly) this was legal, as they have no limits, in all other states it would have been illegal.

So a 5.5 hr drive away, was all they needed to do to make this legal. I am assuming Mom is not right (given judges request) or just not to smart.

I think that’s a fair assumption based upon what we know, which is incomplete information. Setting aside the legality and rights of a 29 week fetus, it seems like the mom showed a terrible disregard for the daughter’s health and wellbeing.

I was looking over some old cases of mine recently. It’s remarkable how the addition of facts can change the analysis of a case. I don’t have time to invent facts that might help make sense of this terrible case. But most likely there are other terrible factors that exist.

That is sort of where most places were before Dodd.

The issue with restrictions and exceptions is that it makes things much more difficult for doctors and patients who should be allowed under those restrictions. There are numerous stories coming out of states now of abortions being denied because doctors are too nervous.
