OT : court/ticket

I guess the title says it all…got a speeding ticket last year…64mph on the I10 where the limit is 60…I guess I am the only sucker to get ‘caught’ a whole 4 miles higher than the speed limit (although my wife said, it’s for all these times I am really above and didn’t get caught)…

anyway, did the defensive driving, and then sent all the paperwork that arrived 1 day too late…

so anyone here can tell me (I am sure a lot can  ) how that works when you go to court? will I get a chance to say ‘Objection your honor’?
Do you address the judge by ‘your honor’?
going there wednesday.

Lawyers out there can give you the real low down, but depending on where you live you may not even talk to a judge. You probably with sit down with some form of city or district attorney and plea it. I would think that since you already did the def driving and it was only 4 points it should not be that hard

Isn’t Texas where they coined the phrase “hanging Judges”?

Hmmm …

I would watch out!

Oh yeah, address the judge as “your honor”.

Not really sure how Texas (that’s where you live, right?) works with traffic violations. But my recommendation (and this comes from lots of experience) would be to contact the district attorney’s office and see what kind of arrangements you can make. Chances are they will work with you and you will not even have to go to court on your perscribed date.

even though it’s in 2 days? I really wasn’t expected to get this letter stating I had to go to court. I thought it got there one day late (memorial week end) no big deal…
apparently it is.

Yeah. Most likely it will not be a problem. Give the DA’s office a call tomorrow to find out who handles traffic tickets. Then call that person, chances are they will work with you. They don’t want to go to court either. Worst case you go to court, plead not guilty and then work out the details with the DA’s office before your trial date.

Francois-

Did you already pay the fine? If not, here’s some advice…if the ticket is for $50, write a check for $50.01. The court will process your check and send you back a refund of the $0.01. Do not cash it!! In doing so, your case will not be considered finalized and thus the points you would normally incur on your license will not be given.

actually, the ticket was $170! for 4mph…I paid already $93 of administrative stuff for the defensive driving etc.

Have you done this yourself or just corroborating this urban myth?

170$ for 4 mph? that is very strange. 2 of my collegues were caught driving too fast too (round about 75 mph) and both had to pay 85$ fee for the ticket and 5$ for each mile they were too fast.

no defensive driving training required and nothing was mentioned about going to court

Thats not true just an urban myth, check this out:

.

was that your colleagues in El Paso oder in Deutschland??

I got a ticket a couple years back in TX and missed the deadline as well. Went to court, waited for them to call my name, they sent me to talk to the DA, worked out that I would take defensive driving. All was cleared up. This was in the commune known as Westlake (in Austin basically). Hopefully yours will be as easy.

here in el paso

the last one just occured about 2 weeks ago

Wouldn’t “Your Honor 'u all” be more appropriate?

4 miles over anf they gave you a freaking ticket. I’d go to see your honor and tell him only a moron gives a ticket for 4 over on the interstate. Be more politically correct though.

‘Objection your honor’?
Being foreign born, you may not realize that it is a custom to refer to judges in this country as “You Filthy Bastard”. Its from the English Common Law.

NONONOOO! You must be a yankee, or some other kind of knucklehead. The correct spelling is “Y’all”. And, it is gramatically incorrect to refer to an individual as “Y’all”. “Y’all” is a term properly used to address two or more people. Those saying “You All” are simply pretenders that are bastardizing a perfectly acceptable contraction, and probably get that sick idea from Hollywood, or some other group of knuckleheads. Sheesh! ;-D

Holy crap :open_mouth: all that for going 4 mph over (~ 7 km/h).

Here you don’t get any points unless you’re going 16 km/h over.

**Believe me, the cop wrote it down as a favor to him. Probably 65 was a break point on driving school or insurance rates, or the amount of the ticket or something. **
