Thanks for the compliment. It was the first Ironman I’ve watched and I was amazed at how international the competitors were. I didn’t realize there were so many Puerto Ricans there - I thought that flag I saw was Cuban (honest mistake, sorry!). Looking forward to hearing from them. I was psyched to see Paula Newby-Fraser there announcing, since I hadn’t watched Ironman on TV since her dominating days. I really hope I can take Ironman Canada photos again next year, but it seems like the powers that be don’t approve of such activities as they want me to get rid of my gallery - maybe I’ll have to work with the official photogs instead.

No, it was NA Sports, which I had never heard of before, who is in cahoots with the WTC protecting trademarks.
What is the argument they make? That you are trading on their brand/trademark by selling photos that have the IronMan logo in them without permission?
If so, my naive interpretation would be that photos that don’t have their trademark on them (shots without the logo) couldn’t be protected by them. Maybe this is wishful thinking on my part.

The argument they make is that all commercial photography from this event is covered by the WTC’s federally registered trademark. WTC and NA Sports extend photographic credentials to Ironman Canada for editorial purposes only. However, this doesn’t seem to justify not showing pictures from the event, as there are many photo sharing sites and bloggers out there that have been doing that for years and ASI seems to be doing the same. I’ll fill you in if I find any more out.
That’s pretty lame, in my opinion. What if you take all the pricing off the website and just “display” all the wonderful photos you took that day while on the public streets of Penticton and the Okanagan Valley. If someone wants to purchase one of your photos, they can e-mail you privately.

Their problem is they charged a fee to someone to be the official photographer (or they take a cut of everything they sell) however, their argument doesn’t make much legal sense (in my opinion) since there are plenty of other commercial photographers out on the course who are charging money for their photos of the race. They are called free-lance photographers, or journalists, etc.
It will be interesting to me to see how this sorts out.
Dont worry about the flag mistake! it is the same flag with inverted colors… I posted some of your photos with your watermark and the website info in a local triathlon forum so all of them can access them and purchase some of them. Too bad the IM controversy but for them bussiness is bussiness! they have the ASI Photo people and they don’t like competition… I take pictures of local and some nearby events like races ant tris, and it is hard sometimes to get permission or a press pass with the IM guys, i got some St. Croix Triathlon pictures on my web http://www.ramser1photo.com/ good luck and keep up the good work!

Yeah, it’s lame but that’s big business, which IM is. I am still displaying them as they are my personal photos and as long as I’m not commercial with them, all is well. I also worked bloody hard to get them all. As for what Frank was saying, the other photogs out there appear to have the rights to use the photos for magazines but not for public consumption, as that is where the officially licensed company steps in.
Great photos, R.S.! Really nice story-telling. The only thing I didn’t really like was the browsing ability - you can’t look at a photo and go back to the place you were. And thanks for posting a photo for me. Interesting about the flags - I wonder which country decided on the design first and which one copied the other.
