All sides have shifted positions to now want TikTok around.

The penalty under the statute is not against the app itself. The penalty is against whoever distributes, etc., the app or hosts the app in the US. The penalty for the former is up to $5000/user in the US and for the latter is up to $500/user in the US. I don’t understand technologically who exactly distributes or hosts the app. But, they’re the ones that could face huge $$ penalties, not the owners of the app itself.

I think it would be internet providers and app stores who would have to pay any penalties for violating the law. Of course, if the DoJ has been instructed not to enforce the ban, nobody will pay any fines or penalties.

Right. These things can get complicated to unwind… e.g. if a data center is storing (and maintaining) video content, would they be subject to fines, if the law were enforced.

I think life will go on, people will look the other way, and the security/ownership issues will get addressed in some back channel way and everyone’s conveniently ok with the app/platform.

Probably. But not today.

Apple still refusing to allow TikTok in the App Store. Apple says the law is clear and Trumps executive order does not override it.

I haven’t heard about what Google is doing yet.
