Truth is an absolute defense to a libel charge. Ignorance is not. So, if this statement were true, it would be a defense to a libel claim.
But, the standard for liability is negligence, meaning ignorance is not a defense. If the flyer’s author(s) ignorantly thought this was true, but failed to do their due diligence to ensure it was true, their ignorance is no defense. They are cooked. In other words, in general terms and subject to some exceptions, it is no defense to claim - “I honestly believed it was true.”

And it would normally be very difficult to prove that an establishment had a “long account of racial profiling and discrimination”. KKK excepted, and not too many others.

A good rule of thumb: On matters of black skin, white skin, and other shades too, it is best to be absolutely clear when writing in the shade of pink. Sarcasm meters don’t perform as well on matters of race. I know mine has to go into the shop for recalibration after too much exposure to the LR.
This has finally reached it’s conclusion and the college is out some major cash. Only issue I have is the sum. There is no way a bakery in Oberlin, OH has ever or would ever come close to making this type of cash. I understand this needs to be punitive but damn!

What is so frustrating with these situations is how quickly people pile on and how easily people who twenty or thirty years ago would be seen in polite terms as unreasonable are believed and supported.
