This is a sad that a blind runner is being sued
That’s too bad. Reminds me of that blind guy that climbed Everest. Truly remarkable.
That’s disgusting. Such a sad, sad state of affairs that somebody would think this is reasonable action to pursue.
What’s the standard protocol in a situation where you basically run someone over. Is it just “oops, I’m sorry”, or is there legal accountablity?
This wasnt friends just bumping into each other, this was a group of runners over taking someone and then colliding with that individual that resulted in some nasty injuries (seperated shoulder). So if they declined to offer any assistance, I guess I dont object too much to the lawsuit (the overall amount can be debated). Of course I kinda laugh when I see she’s suing on behalf of her son for $50k because of what? He’s traumatized that his mom got hurt?!?!?

I think in this case the response would be “sorry, I didn’t see you.”
This whole things stinks.
I gotta ask, if you ran someone over and caused them some injuries, what would your response be? “Sorry”?
You wouldnt feel any accountablity, especially as it was your fault the accident occurred?
Damn you eganski…if there was a LIKE button, you’d get a thumbs up, lol!!!

hopefully the sports community here in Ottawa really gets behind the guys
.
Its not like it was just a small bump, they essentially ran her over hard enough to cause multiple injuries and ones needing surgery. Like was already stated the amount can surely be debated, but im not sure how he or his guide would not be at fault.
It sounds like the plaintiff is being a bit opportunistic in her law suit
“Dunkerley’s older brother Jason, a three-time Paralympic medalist, the Ottawa Lions Track-and-Field Club, and seven other unnamed individuals (including both guides) who were part of the group are also defendants in the lawsuit.”
Why is she suing the other 7 people in the group?

I never said she wasnt a moron who is trying to make a quick buck. I just don’t think him or his guide is not at fault. Honestly i would say it would be the guides fault not him anyways. But then again like every other news story we dont know the whole truth on both sides.
She ran a 10K in 54 minutes two months after the collision. This woman is a fraud
She is a lawyer herself and she knows the Canadian Para Olympic committee has deep pockets and she is going after them for purely monetary gain taking advantage of an accident which is likely why she is naming everyone in the training group as defendants
She must know this guy lives on 1500$/month and that she will never get that money from him
How the hell does this happen from falling down?
“Lepage’s injuries as a result of the collision included soft tissue damage to the neck and shoulder, partial dislocation of her shoulder and labral tears of the right hip, says the statement of claim.”

So correct me if i’m wrong but does that not mean she got a bit bruised and pulled a muscle in her shoulder and hip from having a couple of guys pile onto her?
And thats somehow worth $350,000!!??!! Jeez in the UK you’d be lucky to get £5,000(~$7500).
It will be interesting because as the brief article points out the standard of care for runner and guide isn’t fully developed. Sucks for everyone involved.
I’ve seen a few of the blind runners and guides along the canal in Ottawa and they are fast. Really talented athletes. To run with these guys, the guides need to be both highly talented as runners and able to smoothly provide guidance while running in lockstep, essentially shoulder to shoulder. Sometimes they are leashed at the wrist, sometimes not, either way it’s pretty amazing to see. I tagged along behind one of them back in the fall and they were basically running at the high end of my threshold pace, mid 6’s, and they were carrying on a conversation. Obviously my threshold is their comfortable! They had two out-runners of sorts, companions who would cruise alongside or ahead or behind, depending on what was coming at them. This article makes it sound like they were doing an easy run so probably not that fast.
I’m entirely uninformed about best practice, but it seems like the responsibility is almost entirely on the guide and the accompanying runners. They are they eyes - the blind runner has to trust them to alert others that they are there, passing on the left, overtaking, whatever. Basic communication that is neglected even by sighted athletes. It’s amazing to see these athletes train and move together as one. Hope that this suit doesn’t wreck the supportive community here in Ottawa.
Would you feel differently if she was bowled over by a sighted runner?

Those of us who are from Ottawa know how tight the area of the canal path where the collision took place is on Sundays with hoards of runners of various speeds. In winter, it can become tighter due to snow, ice and bad footing. Seriously, anyone who runs in that area can have a collision/brush with able bodies athletes. I was not there and don’t know the details, but it appears that the runner that went down also raced a 10K in sub 53 minutes a few months later in April. Seriously, when we do sports, there is a chance that we get hurt, especially if we choose to train somewhere crowded (be it on a bike, or running). Sport entails risks. If you run by the canal on Sunday morning, there is a chance that you may run into someone, especially in January. That’s the way it is. It just smells “wrong” to me that the person in question was able to race a few months later (at least this is what sportstats show…it could technically be someone else, but I personally doubt it), and then 1 year and 8 months later is filing in court.
She works as an upper in a government agency, she gets all the sick time she needs, has extended medical benefits etc. With her statement being ‘without’ warning, they were last in a group, the front of the group could be argued as being a visual warning, how do we know that to be accurate, maybe she had headphones, maybe she missed the warning. She raced a 10 k and is claiming lifestyle compromise… bullshit. This will settle out of court for a very small amount, especially after this negative press.

Reminds me of the story about the guy who tries to rob a Best Buy around Christmas. Caught stealing some small electronic stuff by store security, pulls a knife and runs out the door. 2 US Marines out front collecting for Toys for Tots program. Store security yells to stop him. Guys knifes one of the Marines (nothing serious).
Police report later says: man suffers broken jaw, contusion, broken humerus, compound leg fracture and multiple rib fractures after falling off a curb trying to escape a local Best Buy after stealing …
