…maybe not an accident that she hit someone?

Pretty sure her account has been “hacked”. Nobody is that dumb to have that posted (along with the pictures) after hitting someone.

I don’t think that is her account. Her account is private, so I think someone created another account so people could vent.
Having said that I hope the judge throws this case out when he sees it. What a complete waste of the courts time. I think when people file lawsuits like this they should have to pay a huge fine for wasting everyones time. She is suing someone for damages caused by her negligence. Unreal
Even her insurance company determined she was liable and fully compensated the cyclist
.

Agreed - it’s crazy. But we see the world though a cyclists eyes. Spend time with average motorists, and many/most look upon cyclists has nuisances on the road. Because that’s the way they look at ANYTHING that slows their path of transit in their motor vehicle.
There is a whole swath of motorists, who strongly believe that it’s illegal for bikes to even be on the road!
I’d like to think this will get tossed as frivolous and she’ll then be charged for the courts time, but the defendants as well.
Is that likely, probably not.
Seems like a perfect opportunity for the cyclist to counter-sue.
This is in small claims court, in NYS, in NYC. Last I looked it cost $15 to file a claim, and you represent yourself.
Small claims is pretty unpredictable. It would probably be entertaining to watch at the very least.
Best defense is an offense?
“I got zero, zip dollars, and he got paid a lot of money,” she says. “All I’m doing is taking him to court for my car damages. …I need to get paid for my car damages.”
Because yeah, it totally works that way when you were determined to be the liable party.

Her actual account is just @kionnei you can still tweet at a private account. You just can’t read what she tweets.

This, unfortunately, is how more and more of our current society looks at things though. We’re going down the toilet fast and faster…

I don’t think so. There have always been bad people. It’s just in today’s media environment the most trivial matter (like a small claims suit in NY) can get magnified in importance far beyond its implication.
But I’m biased because I have a strong dislike of fatalistic attitudes.
most measures of how civilized our society is have been improving. Less murder, less violent crime, less violent youth crime, less rape, less teen pregnancy. Test scores basically flat.
So, none of that is a measure of people’s sense of entitlement, not sure how you would measure that. I’m certain you can’t be sure to get it right through casual observation though.
Only in America. Your country is so farked up with suing people over stupid things.
Maybe its a fake story.
Several years ago I was cycling in an alley between two buildings, to get to the underground car park where I park my bike. A motorist tore out of another underground car park and I slammed into the side of the car. I was knocked unconscious and awoke to the familiar road rash with a bonus of 4 broken ribs.
things were cordial and we swapped business cards.
My insurance company battled me re the replacement value of my bike, but eventually paid.
6 months later, the drivers wife called me and asked for $4k to pay for the damage to the car. WTF? I forwareded the message to my insurance company to deal with. They laughed. His insurance company laughed too. Eventually he sent through video evidence from a perfectly placed security camera. He claimed I rode right into him so I should pay. I laughed, my insurance company laughed and his company laughed too. Eventually he shut up.
Hopefully the judge laughs at the stupid motorist and she shuts up too.
I hope so
I just think she represents everything wrong with the world
.
Not the whole world; maybe just NYC, and the Hipsterville of Williamsburg/Brooklyn in particular
.
Not in the slightest bit surprised.
I went into the side of car a few years ago. I was going straight down the road, he was coming the other way and indicating to turn across me into a garage. I saw him indicate and pull into the middle of the road, but didn’t slow down as it was my right of way and there was good visibility so no way he couldn’t have seen me. Except he must have completely misjudged my speed as he turned right into me, I barely had time to react and went straight into his passenger door. Plenty of witnesses who all saw it was his fault, and the guy appeared to admit full culpability as he apologised profusely and gave me a lift home as my bike was wrecked (ribs weren’t great either). Exchanged contact details. Next thing I know his insurance company tells me he’s denying liability on the basis that I was going too fast (it was a 40mph limit on a slight downhill, I was doing 30 max and probably closer to 25…). Then a few days later his wife rings me up and starts demanding who’s going to pay for the damage to their car. I pointed out that their insurance company would and she starts ranting about what that’s going to do to their premiums, and questioning why I needed to ride such an expensive bike (turns out the new replacement cost of my 105-equipped aluminum Cannondale was more than their car was worth).
I’ve given up on arguing with non-cyclists who are anti-cycling. They will never understand our perspective because they have no interest in doing so, their mind is already made up, if anything arguing with them entrenches their opinions even more. The best I can do is ride within the laws of the road and encourage others to do likewise, and protect myself as best I can by assuming that every car could do something stupid and unexpected at any point and riding accordingly.
