I really don’t see how he won’t be found guilty of culpable homicide. The article says that it’s similar to involuntary manslaughter. I don’t see how anyone can say he’s not guilty of that.

Yep I agree. We’ll see how much discretion is used by the court.

I like how the judge specifically states he “used excessive force.” You think? Legal jargon or not, that’s ridiculous.

I don’t know anything about SA court or law but it makes sense to me that this wasn’t a premeditated murder. I don’t think he plan it out that way.

Murder? Yes, 100%. Not sure what the circumstances were…he was confused, they got into a fight, she attacked him in an elevator earlier that night, etc. Not entirely sure why they went after the premeditated part.

Guess we will see if the other charges stick…

I agree. Premeditation was going to be hard to prove. But, the prosecutor used the argument earlier that evening to argue that, once she went into the bathroom, he launched the idea to kill her.

My understanding of SA law is that you can charge the highest offense and all lesser included offenses. So, you charge the most you can, and get what you can prove in court.

I believe he will still be convicted of homicide in the form of what we call manslaughter in the states.

Its not “murder” by definition though if it was already proven he had no pre-meditated intent. It would seem to be more manslaughter or homocide by definition and previous rulings by the court. Whatever the cause, he’s already been found not-guilty of intent.

I agree it was probably hard to prove premeditated murder, but I never bought his story. I mean, even if he thought it was an intruder, would you really shoot through a door to kill someone who was no threat? And by putting yourself in front of the door, you are putting yourself into danger if it was a potentially armed intruder; you miss, and you could have a bunch of bullets coming your way. Much better to station yourself with LOS of the door with your weapon aimed, call the cops, and let them deal with it; if the intruder comes out, you’ve got the drop on him.

Not laughing at the poor young lady’s death - but this part was funny.

poor young lady? She’s responsible for her own demise, if she hadn’t been so stuck on the money she would have ditched the violent SOB long ago . . .

So this is a happy gun story?
.

I expect this is as good as the news is going to get for him for the rest of his days.

Not shocking that he ws convicted of some big charge. Kinda surprised that this carries a maximum sentence of 15 years. And I don’t at all understand this:

Judge Thokozile Masipa said there was not enough evidence to support the contention that Pistorius knew Steenkamp was behind a locked toilet door in his home when he shot through the door in the predawn hours of Valentine’s Day last year.

As I understand it, there are no witnesses, and mostly only his story and the physical evidence to help anyone determine what actually happened. If that’s accurate, it doesn’t surprise me that a manslaughter-like charge is all the prosecutor could prove, even if everyone thinks it was murder.
