Need some insight from Lawyers .

Had a meeting with a potential employer today. . .they wanted to discuss something on my background check. Turns out I had a 4th degree misdemeanor on my record. Upon research, we discovered that my “misdemeanor” was actually a traffic violation in Cleveland, OH. I was driving 15 mph over the limit.

Is this a simple case of “someone screwed up processing my paperwork” or is 15mph over the limit a misdemeanor in ohio? I did not have to go to court, mailed my fine, and it was waived. Also, if it is a misdemeanor, why would it show up as “disorderly conduct” on a background check rather than “4th degree misdemeanor: traffic violation”

If it’s an error, what steps should I take aside from calling the court? Any legal action to be taken?

Thanks!!

Call the court and you may get an answer, or at least they may point you in the right direction. Or see a criminal defense atty licensed to practice in Ohio.

In Ohio, all speed violations are misdemeanors.

Jodi? Did you see the link? I will never drive in Ohio ever.

1st offense (Minor Misdemeanor)-None 2nd offense (within 1 year) (4th Degree Misdemeanor)-Not more than 30 days Subsequent offense (within 1 year) (3rd Degree Misdemeanor)-Not more than 60 days ''2929.21(A) & (B) and 4511.99(D)

You can get jail time in Ohio for a speeding ticket. Any other states like Ohio?

Not only that, but Cleveland Heights, Ohio (the city between my house and my work) is probably the most vigilant city in the country for giving out speeding tickets. Oh, and we have about 15 speed cameras in the city. So speed within the Cleveland city limits and you just might get a present in the mail…
