PORTSMOUTH, N.H. — A jogger who’s yelled profanities at passers-by and police alike in Portsmouth, N.H., to the point that he’s been banned from setting foot in the city says he’ll keep on moving — in Maine.
Craig O’Brien of Eliot, Maine, has been summonsed for spouting curses and last month he was charged with disorderly conduct. The Portsmouth Herald reports he was in court again Wednesday, charged with breaching bail conditions requiring him to stay away.
Prosecutor Rena DiLando said O’Brien repeatedly told officers he intends to continue coming to the city to jog, “and there’s nothing anyone can do about it.” She asked a judge to hold him without bail. In response, O’Brien vowed not to return to Portsmouth.
He’s scheduled for a Nov. 17 trial. In the meantime, he says he’ll jog in Eliot.

I realized I had been on ST too much lately on last night’s run. I was coming up behind a girl and she looked back over her left shoulder to see me coming up behind her on the left side. While looking at me she started to veer towards the left and into my path. As I passed her I thought to myself, “wow, some people can’t even hold their line while walking.”
I dunno, but I’m willing to find out…

I was thinking the same thing…perhaps there were USAT officials on the Board of Selectman who were concerned about the town’s image.

I am from Eliot, Maine…where the “jogger” is from…he doesn’t run here…wierd. And the location from which he lives (it was posted in the paper) is about 7 miles from the bridge into Portsmouth…Portsmouth is pretty liberal and very open to athletes. A huge crit took place here last weekend and completely shut the city down, tons of road races, etc. The officers in town that patrol the roads are also super. We spend a great deal of time in town and train in and around also.
It had to be real bad for two reasons: First he was banned, and second the newspaper covered the story.
I hope he isn’t confrontational as running here in Eliot I’m bound to bump into him!

Profanity is covered by the 1st amendment but disorderly conduct is not. You can curse, but you can’t curse at someone if it causes a disturbance.

Yeah, they always try to turn it into disorderly conduct. But if you’re not
committing assult or inciting riots, that’s just a ploy that you can win
at a cost. They just plan for the fact that no one wants to pay the cost.

And? It is not illegal to yell at a cop - it is illegal to make a threat. Cops get yelled at all the time.
He"ll probably complain that I got the roads in South Berwick closed a couple of weekends ago and he was forced to run to Portsmouth.
