If I toss your water bottle out of your behind the seat bottle launcher and you don't know about it, Who gets the penalty!

You for your debris on the course or me for throwing your water bottle on the course?

BEULLER!

Now you’re just being cranky!

.

It would clearly be my fault, and you would incur absolutely no penalty whatsoever if witnessed. This is actually a legal race tactic. “Bottle sniping” can help you gain precious seconds on those who will just pass you again on the run.

yes, gas prices, Mid. east crisis and bush all because of me!

There’s obvious relevance here!

You are responsible for your own equipment. Fault and responsibility are not always the same.

So you’re saying if they are your water bottles it’s your ticket even though I threw them out?

And lets say a marshall saw me throw them off. I mean, what’s the difference between someone unknowingly throwing my water bottles of my bike or someone unknowingly knocking my shoe off my bike?

I had the same arguement w/ my parents when I was 16 and late for curfew even though it was technically not my fault. I’m still the one who ended up grounded. Its your penalty.

I’m guessing there would be an unsportsmalike conduct penalty.

Thank you. In other words “NOT MY FAULT”!

Technically under the rules both of us would get a penalty. I would get a penalty (variable time) for “abandonment” of equipment. Rule 3.4(h). You would get a penalty (disqualification or variable time) for “unsportsmanlike conduct.” Rule 3.4(b). You could also be penalized (disqualifcation) for “endangerment.” Rule 3.4(l). But, officials have discretion when assessing penalties. Thus, if I were an official and I witnessed this incident, I would assess the penalty against you and waive it against the other rider.

p.s. Stop your whining (here and the other thread). There is no knowing or intentional requirement in the abandonment rule. Like it or not you are responsible for your own equipment regardless of whether you “know” what happened to it or not.

p.s.s. Yes, I’m a lawyer and rule books are fun to me.

Right, not your fault, but still your responsibilty.

There’s no whining involved just a simple statement with alternatives. What’s there to whine about? I didn’t get a penalty.

Both!

Penalty for “losing” the bottle goes to whom that bottle belongs too!

Drafting penalty to the person “stealing” the water bottle.

does the water bottle say “burt” on it?

That’s funny!

Another tactic is to have a friend “pace” other runners in your AG to get them penalized, thus increasing your odds at a podium spot.

Also, remove someone’s barend as you pass.
