I took that part to mean that it showed she was not unhappy with the photos.

She was happy with the photos. She just took forever to pick the photos she wanted and in the mean time forgot about a charge. While discussing the charge with the studio her and her husband were calling news station talking about how their photos where being held hostage and using their blogs and the blogs of friends to flame the studio. The emails showed that during this time the studio was going to wave the fee and the problem was solved. The couple continued with fake 1 star reviews on Yelp and the like. They burned the business to the ground because they didn’t review their contract. Fuck’em.

If the photographer’s judgment withstands appeal, then yes the photographer can start collecting. That includes getting and foreclosing on liens on real property, taking cars, garnishing wages, etc. The work of collecting on a judgment can also include the attorney’s fees incurred to collect.

Plus, here in California a judgment accrues 10% annual interest (I don’t know what Texas’ rate is). In Texas, it appears that postjudgment interest compounds annually. That’s not a bad investment if you think you can collect.

Plaintiff can probably start to enforce her judgment upon its entry. Filing an appeal does not stay enforcement of most money judgments, unless defendants post a bond.

The bond premium on a $1mm judgment should not be high, but defendants will have to offer collateral as security, which is typically around 125% to 150% of the judgment amount (to account for post-judgment interest, as noted).

The interesting question to me is whether the papers have liability. They essentially ran with the story without seeking comment from the photographer who, apparently, could have easily disproven the claim.

Photographer is not a public figure, so she may have been able to prove that case too and increased her chances of collection.

Defamation is so hard to prove in this country. Court of appeal could reverse or lower damages. The parties will probably settle and the dipshit couple will issue some formal apology that gets published.

It is going to be tough for the photog to recover the money and her lost business. She may have to drop out of the market for several years and reemerge as a different entity with someone else as the face of the business.
