I have a difficult time seeing how this is controversial.
Labor Commissioner hearings on wage claims are not publicly announced. The only parties who would know of the time and date of a hearing would be the employee/former employee, the employer, and their representatives, if any. The only way ICE would know that an undocumented worker would be there is because they were tipped off. And the most likely source of that would be an employer fighting the wage claim.
You don’t have to be sympathetic to workers who pursue these claims to see the chilling effect that this can have. If employers can avoid compliance with and liability under wage and hour laws by hiring undocumented workers, they will hire undocumented workers.
If ICE wants to follow up on a tip about an undocumented worker who is pursuing a claim, they can wait outside. Why should the Labor Commissioner’s office allow them in.
