AOL - again - any lawyer here?

so, they haven’t recredit my credit card.
AND they have charged some more.
it’s not much, but it’s free money for them…

so s… them I am going to join the sueing legions…

is there a lawyer here who thinks I can actually sue these jerks for whatever…(emotional distress if you wish…willing to cry if needed :slight_smile: )

these guys are a bunch of freakin’ crooks!

If you sue you won’t get anything other than what they charged you. And there’s a much easier way to get it: Contest the charge with your CC company. Tell them you did not authorize it and the CC company will credit your account. If it makes you feel any better, this will also result in AOL having to pay fees to the CC company in addition to losing the money they charged you. But none of that extra money will make it to you.

And yes I’m a lawyer. And in fact, I’ve represented CC processors as well as merchants.

I wonder how much money these morons make this way…definitely millions…
so you can sue someone if you trip in front of his home, and get quite a bit, but if someone freely charges your CC, you only get what they charge? strange…

Francois, Have you tried cancelling the card and getting a new one re-issued? I know it doesn’t quench your thirst for revenge, but it would solve your problem going forward.

Well it’s kind of complicated but the short version is that you don’t get emotional distress or pain and suffering unless there was some physical injury. Despite what you hear, you can’t sue for everything.

Francois, if you do get a new card, keep an eye on it too. AOL has a nack for finding the new CC you get and then charging that one (and backcharging).

Call your credit card company and have them put a stop to any transactions/charges originating from AOL. It probably will cost $15.00 to do this.

Also mail in the cancellation request, and fax it in too, cover all bases:

You might try contacting your state’s attorney general and /or utilities commission.

Sometimes a strongly worded letter on state letterhead can get the ball moving in the right direction.

I had Earthlink for a few years then cancelled when I went to college. One day I got a notice from my bank that i had overdrawn. Turns out they never shut off my service and kept charging me for like 6 months while I was using another bank account. They not only paid for the money they took but they paid all the overdraft fees.
Pretty nice blokes over at earthlink.

I will mail an official letter to AOL with a copy to the TX Attorney General…that’ll get these bastards moving…
