Another happy day in Chicago

Does the charge fit the crime? Putting them in jail for life seems a bit harsh.

"Police near Chicago say six teenagers were trying to break into a house when the elderly homeowner told them to leave and fired a gun after they refused.

The youngest of the group, 14, was shot and killed.

Now the other five, including four under 18, have been charged with first-degree murder as adults, the Lake County Sheriff’s Office said in a statement on Facebook.

One is legally an adult, 18-year-old Diamond C. Davis, the sheriff’s statement says. Three are 17. One is 16. Authorities did not name the minors."

“Illinois law has long held felons accountable for any foreseeable deaths that occur during the commission or attempted commission of a ‘forcible felony.’ This includes the death of innocent bystanders in addition to the deaths of co-felons,” State Attorney Michael G. Nerheim said in his statement obtained by CNN on Thursday.

I just don’t understand any of this. We get all worked up and headlines abound when someone goes and shoots up a school or church but in the City of Chicago in 2018 there were reported 2948 shooting victims and 561 murders. Look it up. Does that not seem a tad excessive?

I understand that a great number of the Chicago shootings involve people that knew of or knew who they were shooting at but daym, those numbers seem shocking to me. Random mass shootings are a horrible thing, but Chicago is one major city out of hundreds in the US. I have no solutions for the gun violence incidents to offer, but at some point we need to stop this crazy train from rolling along.

The answer is simple. Outlaw video games.

Better yet outlaw murder and B&E.

And thoughts and prayers.

Always thoughts and prayers.

This was in a residential community in the suburbs. I agree with many on all kinds of measures that need to be taken to reduce gun violence but there was a little more to this story:

Tuesday at 1:15 am, **six Chicago teens **awakened a 75-year-old resident of Lake County. The teens arrived at his home in a stolen Lexus. Teens were around his car in his driveway.
The homeowner armed himself and went outside. Facing “multiple strangers,” he ordered them off his property, but they “continued to advance on him - one **with a large Knife,” **
Believing himself in danger, the resident fired his gun several times into the ground to scare them off, one teen continued to advanced on him and **he fired again striking one of the defendants **with a single bullet, the prosecutor said.
The teens all ran back to the stolen Lexus and drove away,

First off Lake County is NOT Chicago.

I’m confused as to your position. It’s called the Felony Murder rule. It’s a long standing legal concept and law.

I just don’t understand any of this. We get all worked up and headlines abound when someone goes and shoots up a school or church but in the City of Chicago in 2018 there were reported 2948 shooting victims and 561 murders. Look it up. Does that not seem a tad excessive?

And this is why I get incensed at the anti-gun crowd on here. They ignore these poor usually black usually young victims but the second there’s a “mass shooting” out of the woodwork they come foaming and frothing.

Certainly sad case. But would you propose modifying the felony murder rule? How? Or would you not allow 16 y/o’s to be charged with adult crimes?

I’d leave the law and charges as they are myself.

Yeah, there are times felony murder might seem excessive. But this isn’t it. If they stole the car, got in a wreck, and one of the group died it may be too much. They get some points for dropping the dying kid off with a cop, but overall the charges are fine by me.

Honestly, this is a great law to have. Commit the crime and be liable for anything that happens to your comrades. In theory that’s a real deterrence…guess not.

I looked into the law a little bit and found that “the maximum punishment you can receive if you’re convicted of first-degree murder is life imprisonment. Not everyone receives the maximum punishment when they’re convicted; the minimum punishment is 20 years. If you’re convicted of first-degree murder, you must serve all of your sentence. You can’t get out early.”

And I am OK with this. I wonder for society if it’s better to put them away forever as opposed to let them out in 20 years?

I’m guessing there will be a plea deal and they will plead to a lesser offense. Some 90% of convictions come from plea deals.

I agree that this is a good example of what is felony murder.

It’s also another case of–don’t bring a knife to a gun fight.

If the 75-year old had gunned them all down with an AR-15, then you might hear the “anti-gun” crowd around here get up in arms. I’ve yet to hear any of the anti-gun folks here suggest that all guns should be banned. This one sounds like a reasonable use of force.

Nope. I’m good.

Do ME a favor. Don’t be a dick just once in your life.

The answer is simple. Outlaw video games.

Was this supposed to be in pink? I guess that video games aren’t played in the UK, Australia, Europe, etc. Video games are not the problem.

Then maybe process I’m annoyed with the fact the bleeding hearts on here only get all gun banny when it is a “mass” shooting instead of when the same number if kids get killed in a weekend in Chicago.

Sadly shooting deaths of poor, black people are so common that they do not make news. The number of poor, black gun victims far out weighs the number of mass shooting victims.

Of course the US will continue to do nothing about gun violence. Thoughts and prayers.
