WASHINGTON – The new Obama administration circulated a draft executive order Wednesday that calls for closing the controversial detention center at Guantanamo Bay within a year and halting any war crimes trials in the meantime.
Closing the facility in Cuba “would further the national security and foreign policy interests of the United States and the interests of justice,” read the draft prepared for the new president’s signature.
While some of the detainees currently held at Guantanamo would be released, others would be transferred elsewhere and later put on trial under terms to be determined.
Ah ha! So, same shit diffrent pile for these prisoners eh? Only, chances are the pile of shit these people will be in would be on the main land US and thus bring these potential terrorists and their potential buddies to the main land to try and free them. Something about the fact that they are on an island 90 miles from main land US just sorta gives me the warm and fuzzies. Thier buddies trying to break them out of a prison on our shores…not so much.
How can a suggestion in a draft already be a mistake?
He believes Gitmo is a boil on America’s butt and he plans to lance it. You and I disagree with that analysis.
He believes that the Gitmo prisoners can be held securely somewhere else and possibly even securely held in the continental US. I think he is right that we have the ability to securely hold here or elsewhere.
He believes there may be different procedures than the ones currently being used to try them. I will wait to see what he suggests before determining if a different procedural framework is a mistake.

The prisoners weren’t put in Gitmo to give you the warm and fuzzies about not having to fear some sort of Jack Bauer 24-style prisoner escape, they were put their for legal reasons. If they are in our country I am relatively certain their location while remain undisclosed so you won’t have to worry about Islamo-Facist prison breaks threatening our mainland.
Even many on the right have said his initial decision to suspend the hearings while he looks into things further was a relatively tempered and measured approach to the issue. He has made no secret of the fact that he wants to close the place, but not doing so immediately and taking some time to study information he has probably had little to no exposure to strikes me as a rational choice.
What do you have to say for one of the Bush administration’s own lawyers admitting to the fact that we tortured people down there and thus have compromised our own ability to prosecute them?
The same could be said if there was a colony of people with an incurable and spreading plague…could we keep them here? Sure…would we want to?
If it were incurable and highly contagious, I can think of no better place to keep them than here where we have the ability to effectively contain them.
2.) These people DO NOT have the protection of the Constitution, nor standard Civil Rights…they are not protected by NATO nor the Geneva Convention…and if you think their friends cant strike around the world - there are some folks in Embassies and on the USS Cole who may not agree.

This is a fallacy. If you disagree with many things an administration is trying to implement, you WANT them to fail. The right used this argument to some effect only because there is an extreme left contingent that actually wants to see our military defeated in the mideast. THAT was repugnent to many on either side of the aisle, and the “his success is our success” idea had more relevance.
Will be interesting to see if the detainees end up being tried in the US courts, was a pretty fruitless and time consuming effort in the Musawi case. It would be a gift to the TLA...and a huge expense to taxpayers.

Under what theory of justice or morality can you justify bad behavior simply because your enemy engages in worse behavior? Certainly you can do things in self-defense that you might not justify doing if you were an aggressor. And certainly there are actions you can take in response to an act of war that you might not justify taking otherwise. But on what theory can you defend committing an atrocity (even of lesser degree) simply because your enemy commits an atrocity?
I was going to say that…but that just gets the apathetic liberals all worked up. Fact is, we are the 600lbs Gorilla and the entire world SHOULD be afraid to wrestle us.

But you do understand that this establishes a maximum penalty, not the necessary one.
As you read further, you come to understand that compassion, forgiveness and love also play a role.
Thus, if you are basing your justification for committing one atrocity as an appropriate response to another on this passage in the Bible, I would suggest that your read more deeply and with a more fully developed sense for the entire text.

There is only one way to deter an enemy. The enemy must be afraid of what you will do.
