It would depend on how it’s interpreted or perceived by the race officials:

6. Blocking, charging, obstructing, or interfering the forward progress of another athlete;

- Unintentionally: warning and amend
- Intentionally: DSQ

7. Unfair contact. The fact that contact occurs between athletes does not constitute a violation. When several athletes are moving in a limited area, contact may occur. This incidental contact between athletes in equally favourable positions, is not a violation;

Looks to me like that was an intentional "hit" right at the end to get her to ease up. Her arm shouldn't be there

And no, her arms are flailing because she is in an all out sprint and running out gas. I’m not going to fault her for that, it happens and she didn’t look like she impeded her anyways.

that is what I see too. And I would have been okay with a DQ had they done it at the time. But I kind of feel judgement calls shouldn't be reviewed after the fact so I am good with keeping the results as is.

Judgement calls as in....determining if she impeded or not? Because video replay is how they pretty much confirm every penalty. Or are you saying that type of penalty infraction should only be determined during the action?

Right. I mean you should not review subjective judgments after the fact and enforce a new penalty.

I think I am okay with over-turning a subject judgement after the fact with video review.

Because she got out sprinted by .1 SPivey will now have a reputation of not being having a good kick and Perterer will have the reputation of having a great one.

I tend to agree. I don't see flailing. Her arms are pumping in a consistent motion until the one moment her right arms shoots out to the right. But I also don't think that's what decided the race.
