Why is this Russian doper still racing in the US(Kona excluded)?

I know he did his crime, did his time, etc.

But, why is he still racing in the US post-USADA bust and Icarus release?

I believe because he was never convicted of doping because he used the excused that the melodonium was ingested prior to the ban, and because of its half-life, it remained in his system when he was tested, IIRC at St Anthony's.

He is a foreign doper cited by United States ADA. I dont think he should be racing in the United States. Is that clear enough comrade
