This just showed up on my Google news. It is about Motocross. So can the word Ironman be used in two unrelated events?

It's about industry/context. I can start McDonald's Plumbing, but not McDonald's Hot Dogs. The issue becomes one of "consumer confusion." In the plumbing example no one is likely to think my business is affiliated with the burger chain, but in the hot dog example they might.

Apple was allowed to use the name even though Apple Records (the Beatles) had the mark because it was ruled that music and computers were very different domains.....then years later iPod/iTunes were released and the legal wrangling began.

Ironman has been an event on the Surf Lifesaving Calendar in Australia/NZ long before anyone did anything swim/bike/run related in Hawaii..

Every now and then WTC goes after someone and that is why the Double Iron Tri's around the world are now called Double Ultra's or in the USA Double Anvils..

 Yes, probably. Someday they might get a letter.

The WTC IRONMAN registered marks are pretty specific. I think some are global registered marks. You can see them listed at the bottom of any of their press releases in the boilerplate.

So if they think it’s confusing because it’s a sport maybe. Trademark rules are a little bizarre because to keep the rights you have to show that you actively protect it.
