Hypothetical question about homeowners liability for injury and insurance

Hypothetical situation. Say that someone was helping a next door neighbor do something and fell and was seriously injured. This person spent a couple of days in ICU and several weeks in the hospital and rehab. This person might realize that it was their fault that they fell and does not want to pursue any damages against the neighbor.

The injured person's insurance company (medical) contacted them and asked if they were on their property or someone else's when they fell. The injured person isn't willing to lie, but doesn't want their neighbor to get sued either.

Is it likely that the insurance company is planning on suing the neighbor for damages? Is this going to happen regardless of what the injured person wants?

Hypothetically speaking only, if the person tells their insurance company it was their own fault they fell and explain in detail why that is, that person's insurance company would think less of trying to sue. The insurance company would stand in the place of the injured person if a suit was filed ( subrogation claim) so if the injured person acknowledged and said it was their fault, it would be difficult for the insurance company to prove the neighbor was at fault and prove negligence.

The policy for the injured person would spell out the insurance companies rights in terms of subrogation and if the insured ( insured person) had any rights with regard to making that decision.

Check the policy,
Tell the truth and explain how the accident happened.

The hypothetical person asked me to tell you thank you for the information on the hypothetical situation. The truth shall set them free, and their neighbor too. I did advise him to read his policy. Thank you for taking the time to answer.

Thanks. They had 13 hypothetically broken ribs, two of them were broken in two places. He's 77 years old and shouldn't have been on that hypothetical ladder. :)

I get those dumbass letters from the insurance all the time. It’s always my fault so stop sending them haha.
