wow! how ridiculous is that? I've done swims that were a lot more dangerous than that!

Maybe a technicality here but he never completed swimming across the lake therefore he never fulfilled the condition requiring a permit.
What are they charging him with intent to swim across a lake?
They have no evidence that he was going to swim all the way across the lake..unless he admitted it.
Things like this are why I don't do training swims at guarded beaches.....

I would be very curious to see how many citations have been issued in the last year to motorists for unsafe acts toward cyclists in that same municipality. Incredible.

This is really about disobeying the lifeguard, who I'm sure, is the one that called the cops.
The swimmer deserves the ticket. He swam outside of a marked swim area. Since that park is patrolled, he should of cleared it with the park officials first.
Besides, he's swimming alone across a lake. Poor judgment, especially for a Dr.

That report makes me thankful for the folks at the East Bay Regional Parks District here in the San Francisco Bay Area. You can swim to your hearts content in Lake Del Valle anywhere you want (north of the boat launch) whenever you want to, by yourself if you are so inclined ( I never would).

The lakes I swim in allow swimming within 100' of shore at any time with no restrictions. They even have bouys set at 100' around all of them. If you swim outside 100' from shore, you must be escorted by a boat, canoe, kyak, etc. and they need to have a PFD onboard for you. It is not a big deal. The lakes are rather large and rather busy on the weekends, so I get where the rules come from. I just have a buddy kyak along with me if I don't want to swim near shore.

Agreed it was stupid, but the $1000 and 90 days is the maximum penalty. Doubt he will get anywhere near that. And in the story that was referenced a few days ago, he admitted his mistake and said it was his fault.

Like I mentioned in a earlier post, my uncle lost sister when she cramped halfway across Lake Nokomis. She was swimming by herself. She was a strong swimmer.

Never had it during a swim, but I've had adductor muscle cramps that if I was in a pool/lake away from shore, I'd have had some serious trouble. Both legs, almost in a fetal position and unable to move them at all.

Whew that's a steep fine. Our local lake only hands out $100 tickets and to this day many of my buddies have been caught and only warned. I don't know of anyone who actually got a ticket. That's why you have to go early in the morning before the patol starts.
He'll probably get off easy because he admitted wrong doing and I'm sure is willing to pay the fine.

I have had plenty of calf , foot etc cramps when swimming Usually not an issue as you just need to flex the opposite muscle (quad to hamstring or similar) to stretch the offending muscle. Surfing in cold water, and before I know about the above trick, I once had both hamstrings and both calves go at once. That was fun had to I couldn't stand up from a crouch once I got to the beach. At that point it was pretty hard to turn around and go back to water deep enough to stand up.
It is all about having a cool head in the water. A lot of people get cramps from using swim fins so SCUBA classes teach people how to stretch a calf in the water. Tread water, or deadman float, etc and stretch. I have spent enough time around the water that I am comfortable swimming alone. I have to be I do enough solo water sports that it is inevitable that I wind up in the water from time to time with no one around. It is a matter of being smart about it. When I swim alone I always wear a wetsuit which gives me plenty of flotation.
This has gotten me thinking about the swim certification suggestion that has been discussed in another thread following the NYC tri death. Perhaps an open water safety or "lifeguarding lite" would be a useful suggested course for entrants....

The rule is there because people in the past were dumbasses about it. Granted it's a relatively safe body of water, but you have to apply the same law to everyone.
Annoying as it is, I'm with the state on this one. But then my area's seen double red flags (beach closed to everyone but surfers) for about 5 of the past 7 days, and had something like 6-7 swimmer deaths in that time period because the touristas would turn around and go back in the water after the sheriff's office has ordered them out of the water.
As a result, the SO spent a lot of time writing $100+ tickets for entering a closed beach, and I'm all for it since the threat of a fine probably saved lives once word got out what was happening.

Question for the MN folks, are there not a plethora of organized open water swim times at those glorious lakes?
Here in Colorado there seems to be organized open water swims almost every night and on the weekend mornings all over the Denver/Boulder metro. Usually cost between $6-$10.

I always do open water swims with a friend or one of my kids in our bright yellow kayak... don't want to get chewed up by a prop... which is why that rule is there I'm sure...
