With some bondo, some 100 and 220 grit sandpaper and some black spraypaint you could make that ding invisible and functionally as good as new in about 15 minutes and go out riding as opposed to dealing with the LBS/Scott USA. An autobody shop might be your best option if you aren't comfortable doing it yourself.

I wouldn't worry about it. Yes, bondo is appropriate but you can also use some JB weld or other 2 part epoxy, sand it, a little touch up paint, and it would be as good as new.
I had some paint scuffing in that area on my Parlee TT after I traveled with it in a BikePro case and TSA jacked up how it sat in the case. There was no cracking or anything, just the paint got scuffed up, but it was no problem to fill in the paint and it looks great now.

Brought the LBS to small claim tribunal and the judge is for the view that the damage is not caused by me but rather in during assembly or transportation/shipment.

The shop even has the cheek to accuse me of demanding for a full replacement when all I asked from them is to investigate the cause of damage. I have the email correspondence as proof. What caused me to smile the most is when the bike shop representative tried to tell the judge that I 'threatened' to blackmail them by stating I have not spread a word about what have happened, and the Judge actually brushed he off and ruled in my favour.

information left out that this bike had been raced twice, once locally and another time overseas during the time the bike in his possession. why would the manufacturer be liable for this damage? it could have been damaged during the race or when bike was shipped.

looks like maybe the tire was too close and forced a rock through there. a rock hitting that small point might break it
