High Impact Bike being Sold

ICBC (BC, Canada Insurance Company) took my bike after my accident. I repeatedly told them that due to the high impact collision (an impact strong enough to rip the front fork off the bike) the carbon frame and wheel were compromised and that the aero bars were actually cracked around the risers / arm cradles (the area where you rest your bodyweight). I asked them to ensure that it would not be sold for spares as it could cause a significant injury or death.

They sold it through auction anyway. And now this guy is selling it as 'mint condition'.

It frankly make me feel a bit sick that someone might actually spend good money on what amounts to a ticking time bomb in the case of the aerobars and Russian roulette with the frame and wheels.

Unfortunately, the aero bars and wheels have already been sold. Someone is out there riding bars with seriously damaged carbon. If anyone knows who purchased them then I highly advise them to stop riding them immediately. The bars were TriRig Alpha X. The impact on the pads and risers cause a crack around the base of each riser under the basebar.

Hed Wheels - Rear was ok just a bit buckled. The front was hit VERY hard and the Hed Jet Black brake track had gnarled aluminium and will shred brake pads. Frame - Who knows. I completely T Boned a vehicle at just under 25mph. I wouldn't ride it.
Just a heads up ..... if you know anyone who purchased this stuff then let them know.

Can you document that you informed the insurance company? If so, is there a federal agency in Canada that overseas insurance companies? If so, perhaps that's the direction to go. This seems like negligence at its very worst.

It is owned by the Government I believe ....

".. The Insurance Corporation of British Columbia (ICBC) is a provincial crown corporation in British Columbia created in 1973 by the NDP government of British Columbia .."

Although I am not sure they are legally responsible, I assume they can sell the bike for parts, there must be some form of accountability in ensuring that these things do not end up back on the road in an unsafe condition.

James, You've probably already let them know, but I would think Ruster, HED and TriRig would all be interested to hear about their products being put out on the market after insurance "totalled" them post-accident. Crazy that they sold these items!

If you are certain it is your frame, you could also contact the seller to give them the history of the bike. Just a friendly message to let them know that it was your former bike that the insurance took back after a high-impact crash that caused major damage to bars, fork, wheels, etc. You just wanted to let them know for their own liability that the frame could be compromised and unsafe-- that the insurance company was informed of this and advised not to resell it, but they did anyway.

Will do but he will know already. He had the complete bike, the fork was completely ripped apart but still attached to the front wheel, which he was selling.

haha... wow. When I first looked at your post, I thought maybe the fork and wheels followed a different path. He may not be the most up-and-up seller. But, if you notify him, then you at least have done as much as you probably can do on that end.

I would notify your insurance company and, if they're unresponsive, contact the local media (newspapers/television). If they're doing this with your bike they very well might be doing it with cars as well. The public should know.

Therein lies the issue, of course they are doing it with cars as well. All insurance companies sell cars for parts when they tap them in. The issue I guess is more the guy reselling it. I know the ICBC auctions are only open to registered people, maybe they can remove his auction license.

I guess the difference between a car and a bike is that pretty much every part on a bike is safety critical whereas plenty of parts on a car are not.

Yep. Maybe the licence is given on the understanding that any salvage is going to be done safely. With a car that obviously works a little better if you only look at the fact that a bike can 'look' ok but still be a death trap. A car that looks ok has usually been tarted up to look ok again.

I don't think they should sell carbon parts form a crash, period.

There is also a department with the ICBC separate from the wreckers, I think it's inspection or enforcement, try getting a hold of that office

Another difference with cars is that (at least here in the US), once they've been declared a total loss, their title is marked as Salvage and it follows the car forever, especially now with a Carfax report being so easily obtained. This of course assumes that the insurance company is actually reputable and there isn't any "title washing" happening after the fact.

With bikes, there is no registered title that can be marked salvage and easily referenced by potential buyers.

Bump, I missed this back when posted, but I think it is worthy story to share. Crazy to think about that sort of fraud. Who would do such a thing and endanger the lives of someone else. Makes me think twice about buying used. Fwiw I got here from reading your post in the classified about your new bike that you are selling. Any updates to the story?

I missed it the first time around, but looking at the ad where he advertises it as a "Diamond bike" and he's clearly parting it out I would have avoided it thinking it's stolen anyways. Also curious for an update!
