Well, he was explicit about that when he nominated Miers, who he said was the most qualified person in the country for the Supreme Court. I just figgered that it was a pretty important criterion (no changing in 20 years), so I thought he'd apply the same criterion as he moved to less-qualified candidates. Silly me.

I guess my point is that none of those views is in conflict with a conservative ideology, and additionally and more to the point, even if they were, holding them as opinions does not mean that he thinks they're supported by current law. In other words, I think they're irrelevent, in the main.

It struck me that this project was more about a legislative agenda than a judicial one. To the extent that he was calling for legislative reform or action, then that is well within a conservative judicial philosophy. If he believes that advancing this agenda is a proper exercise of judicial authority then that is far afield from a conservative judicial philosophy.

I really don't see any problem with any of this. It is pretty hard to make an argument in favor of enforcing sodomy laws. I don't think I have ever heard one. Violation of privacy at that time, especially by the FBI under Hoover, was a real problem. There are apparently recordings of MLK that would make a porn queen blush.

Aruging all of this is to be found in the Constitution is another matter completely. The paper was described as a set of legislative proposals. If you want to change sodomy or surveilance laws via legislation, that is fine by me. Just don't argue that it is baked in the Constitution. That is activism.
