What if Bush Wins The Electoral Vote but Loses the Popular Vote Again? Can't Post

It's a very real possibility that this could happen again, what with Bush consistently outpolling Kerry in Wisconsin, which went for Gore in 2000. That's a total of 10 electoral votes. If Bush holds Florida or Ohio (but not both), he could end up with 273, or a few more, electoral votes, which would give him four or five more than Kerry.

Is everybody ready for the court battles to come? ;-)

There won't be any court battles, unless one of those key states is really close, like Florida. Remember, the court fight wasn't about the electoral process, but about how the votes were tallied.

There'll be a lot of whining if it happens, though.

CTL, whenever he comes on, has an interesting take on what might happen in the states where the vote totals will end up being within 5,000 ballots of each candidate. Lots of lawyers from both sides standing by to contest the final count :-)

He's a legal-beagle, with election law as a hobby for his party in election years.

AMEN!!!!!!!

The concept that lawyers are the problem, period, end of sentence is mind boggling.

People who are otherwise careful not to make sweeping generalizations suspend reason when there is an opportunity to take a shot at attorneys.

Literary criticism question: Why did Shakespear say first, lets kill all the lawyers?

Clue: not because he hated them.

That lawers are needed/usable suggests that there is some ambiguity in the process in which they can ply their trade. The election goes to the team with the most talented lawyers, and the winners argue that this is what the Founding Fathers intended all along. There should be no ambiguity.

I'm sorry, but I do not see the problem here. So what! Play by the rules, or change the rules. BUT do not complain about the rules after the game. Look, if if it was such a terrible and wrong thing, where have all of the lawyers, court cases been the last four years? Or is it some sensational media game? Well of course it is a media game.

This is like saying, but I went faster on the swim, bike and the run, I have to be the winner!! Transitions shouldn't count!!

Well, I'm not quite ready for the court battles yet, but I have actually spent some time today starting to get ready.

In Michigan, there has actually already been a lot of election day litigation that has been filed and decided related to ballot proposals and also whether Ralph Nader should be on the ballot. This is fairly standard and takes place almost every election. I also heard that a lawsuit was filed today against the Secretary of State's Office demanding that votes that are cast by a registered voter that goes to the wrong precinct should be counted.

Here's a new acronym for you: HAVA, for the "Help America Vote Act". One of its provisions provides that if you show up at polling place and are not listed on its roll of registered voters, you get to cast a provisional ballot of sorts. These ballots are supposed to be segregated and not counted until the appropriate clerk has verified that the purported registered voter is actually registered. Now, what's going to happen on election day with these ballots? Could affect the outcome of the litigation.

My wife, who still lives back in a suburb of Detroit, was fond of calling it "The Mogadishu of North America", just for the kinds of things you're talking about. She first saw it back in the 2000 election (we had relocated back to the area in late '99, after my retirement from the military).

Count on Detroit for massive voter fraud by "the underserved majority". After all, it isn't a wrong if the desired outcome (the election of Kerry/Edwards) is morally good, now is it? ;-)
