Once again, Republicans trample on people's rights ... Can't Post

NEW YORK (Billboard) - Singer-songwriter Jackson Browne is suing Republican presidential nominee John McCain and the Republican party for using his song "Running on Empty" in a recent TV commercial.
In the suit, filed in U.S. District Court in Los Angeles, Browne claims McCain and the party did not obtain permission to use the song for an ad in which "Senator McCain and the Republicans mock Democratic candidate for president Barack Obama for suggesting that the country conserve gas through proper tire inflation."
Browne, a lifelong Democrat, is seeking unspecified damages as well as a permanent injunction prohibiting the use of "Running on Empty" in any form by the McCain campaign.

"Not only have Senator McCain and his agents plainly infringed Mr. Browne's copyright in 'Running on Empty,' but the federal courts have long held that the unauthorized use of a famous singer's voice in a commercial constitutes a false endorsement and a violation of the singer's right of publicity," Lawrence Iser, Browne lawyer, said.

Poor, poor Jackson Brown. Held up as an example of trampling on peoples rights. Wonder how the women he beat up feel about his new poster boy image.

"Posterboy"...hyperbole much?

So because he beat on Darryl Hannah...his music can be stolen, that is something I believe the RIAA would be against. They don't care much for stealing music I hear.

I recognize this as just an attempt to push the direction of the thread away from the illegal use of copyrighted material by the Republican camp...but as David in FL reminds...stay focused.

Actually it isn't that at all. It is sheer disgust at Jackson Browne.

I know the Democratic Party believes in moral equivalency but there are a lot of us out there who don't so maybe YOU should stay focused on what is important!

Being from Canada, I figured you must be talking about the Human Rights Commissions.

In America, music is typically put up for license by anyone with the payment of an upfront designated royalty. I don't know if that is the case here, but it is the case nearly always. If the musician didn't want it used by others, he simply has to say no to the money.

Is that not the case in this situation?

So can Jackson Browne have the RIAA sue McCain for "making available" to the entire U.S.? Hmm, the Copyright Laws allows damages of $750 - $150,000 (!) per song, so 300 million people x $700 = $2.1 billion. That ought to put a dent in McCain's campaign finances.

Did you really just scold sorelian for discussing a copyright infringement case because the subject has committed a more serious offense?

No one has established copyright abuse yet. Is there some allegation that standard royalties weren't paid or didn't apply?

Before people jump to conclusions one way or the other, it is helpful to have a few facts first. I am just asking some very simple questions, which apparently none of the conclusion jumpers here can answer or even be able to admit they can't answer.

There really are facts out there in the real world. No lawsuit typically needed.

And yet at least Jackson Brown's attorneys feel that this isn't typical...hence the lawsuit.


Not a lawyer myself but some things do stick out.

1) Jackson Brown apparently owns the song.
2) He apparently did not authorize its use
3) Its use it has been concluded by his side amounted to an "endorsement" which was never given.
4) ????
5) Lawsuit.

That really isn't jumping to conclusions so much as reading the article from the OP.

Gotcha. New rules, then: No discussion of issues pertaining to a subject beyond the most serious among them.

No talk of the age of China's gymnasts, only their human rights record. No talk of professional cycling unless it's focused on the doping problem, and no talk of triathlon unless the topic is athletes drowning during the swim. No talk of John McCain unless it's with regard to skin cancer, or...

The original post is strangely silent on the simple question of whether Jackson Brown put his song out for public play royalties or not. As I understand it, this is a simple question. If a bar plays his music, he typically gets a standard royalty. Same for every other artist.

Now the Stones in particular have never played that game. When Gates wanted to use "Start it Up" in his windows introduction, he had to negotiate a deal. The Stones didn't want him to use, so they quoted a ridiculous price, $8,000,000 or something, knowing that no one could pay that. Gates, not being no one, paid it.

Geez you Obama guys really need to lighten up. It is Friday. Just having a little poke at you. You must have missed the smiley face.

Also, I am sorry. Being female means that I don't feel to sorry for anyone in domestic abuse cases. Given how the threads in the Lavendar room usually run there is no rule about not bringing that up. I don't feel bad for Jackson Browne one iota. Plus this gives a has been singer a public forum to bring himself back into the public conscience. No surprise there.

Besides I am writing footnotes on Preferred Stock. It is a hell of a lot more fun to piss all you guys off. Keeps the boredom down to a dull roar.
