I have been preaching this to opposing counsel for years. However, in my experience, plaintiffs' attorneys are more often willing to explore settlement. It is their clients who seem reluctant to do so. However, I have a few clients (I am a management side labor/employment lawyer) who seem to want to fight everything, regardless of the cost. Good for me, not always so much for them, but, what are you going to do? We can only advise our clients, we cannot make the decisions for them.

JSA - One of my favorite lines is to tell those kinds of clients that I while I disagree with the merits of their decision, I'm working hard at building my retirement portfolio, so I am not going to try too hard to talk them out of their choice.

This is a constant refrain from the litigators at my firm. Sometimes you just have belligerent clients though, or (perhaps worse) the clients who say "I don't care if it makes practical sense, it's the principle of the thing..." Amazing how quickly fealty to principle is left by the wayside when the bill starts to skyrocket...

I can think of a few cases I'm managing where the plaintiff might benefit form reading that. :)

Pretty much describes all of my cases. I'm sure I have one or two where "Girlfriend's gonna get paid," but most of them would be better off settling. Of course, this article might work against me. Most state agencies in Texas don't want to settle at all, and if I can get them to consider it, they don't want to go above $5,000.00 regardless of how good the plaintiff's case may be. All I need is something else to make them less willing to settle.
